Appeals continue in the case. One of the current grounds is the discovery that Miami reporters were being paid by the U.S. government to write inflammatory articles about the Five while the trial was underway.
On October 7, 2011, René Gonzalez was the first of the five to be released. In May 2013, after serving part of three years of probation in Miami, he was given permission to return to Cuba permanently. On February 27, 2014, Fernando Gonzalez completed his sentence and returned to Cuba the next day. Antonio Guerrero’s release date is scheduled for September 18, 2017, and Ramón Labaniño is scheduled to be released on October 30, 2024. Under the terms of Gerardo Hernández's sentence - two life sentence plus 15 years - he will never be released.
